In fog you pull out to overtake a slow lorry although you cannot see far enough ahead to know whether anything is coming. Which article do you break, and how is it graded?
The answer
D — Art. 17.1, third degree
Why
Art. 17.1: overtaking on the left is forbidden when the driver cannot see oncoming road users from far enough away to overtake without danger; the KB of 30 September 2005, art. 3 9°, grades it third degree.
Why not
- A Art. 17.2 3° is about crests and bends; the general visibility ban is art. 17.1.
- B Art. 17.1 has no list; it applies wherever oncoming traffic cannot be seen from far enough.
- C Art. 16.7 concerns the driver being overtaken.
